My Son Opened Three Credit Cards in My Name

I walked around back to where they were all standing at the twins birthday cookout, but I did not come to make a scene at a childrens party. I came in my Sunday best, with a folder in my purse, and the calm of a woman who had spent the week clearing her own name.

My son saw me and barely glanced up, sure the old woman whose credit did not matter had come to accept the ruin he left her.

He told me the cards were in my name so technically the debt was mine, that my credit did not even matter anymore at my age, that I should have paid closer attention, but he forgot that cards opened in your name without your true understanding are not a debt, they are fraud.

After my son opened three credit cards in my name to build the familys credit, while I was still reeling from my husbands death and not thinking straight, then ran all three to the limit on vacations and electronics and a big TV I never saw and left every collector to me, I did not scream. I said you may be right, and I shut my door soft. And then I called a lawyer.

Because here is what my son never understood. He opened those accounts and made those charges. Opening credit cards in your elderly, grieving mothers name and running up debt she never authorized or benefited from is not building the family credit. It is identity theft and elder financial exploitation, and it is a crime, and the debt can be lifted from the victim.

My attorney helped me do exactly what the law provides. We filed fraud claims with each of the three card companies, documenting that the accounts were opened and used by my son, not by me, that I never made or benefited from the purchases. That is the legal remedy for identity theft, even when the thief is family.

The card companies investigated. The charges, the vacations, the electronics, the TV, all traced to my son, not to me. The fraudulent debt was removed from my name entirely, and my credit was restored. The debt landed where it belonged, on the son who spent it.

So at the birthday cookout, I did not scream. When my son finally looked up, I said, in front of the whole family: I have some news. Those three credit cards you opened in my name, and ran to the limit, the card companies have looked into. They agree the charges were yours, not mine. The fraud is off my name now, my credit is restored, and the debt is yours, as it always was.

The backyard went quiet. The family turned to stare at him. And he had to explain, in front of everyone, how he had opened cards in his grieving mothers name and stuck her with the bill.

My credit was restored, my name cleared, the collectors silenced. The debt was his to face.

He said my credit did not even matter anymore. It mattered to me, and I got it back. I did not raise my voice once. I just remembered that debt run up in my name without my consent is fraud, and I got help proving it. My name is clean again, my own. And my son learned that even a grieving old woman can defend the good name she spent a lifetime keeping.
