My mothers pension started going to a different bank account in spring and she didnt notice until the fall because her rent stopped coming out. Shes seventy-nine. The account my brother had been quietly routing our mother pension into for six months was not a protected account for her benefit at all. It was his own personal checking, and the money had not been sitting safe. It had been spent.

A power of attorney is a duty to act in the person best interest, not a license to move her income into your own account and use it, and when I pulled the statements my brother had been too careless to hide, they showed our mother pension flowing straight into his checking and straight back out again on his own bills, six months of it, while her rent went unpaid and she nearly lost her apartment.

That is not protecting an elderly woman from scammers. Under the law it is exactly the thing a power of attorney exists to prevent, a trusted agent using a vulnerable person money as his own, and it is called financial exploitation of a vulnerable adult.

I did not try to sort it out at a family dinner. I took the bank statements to adult protective services and to the police, and I called an elder-law attorney the same day, because a seventy-nine-year-old woman about to lose her home is not a matter you handle gently over coffee.

The attorney moved to revoke my brother power of attorney and had it stripped from him, because authority misused is authority forfeited. The court appointed a neutral party to oversee Mom finances, her pension was redirected back to her own account, and the police opened an exploitation case.

The rent got caught up before she lost the apartment. Adult protective services made sure of it, and the back payments came out of the recovery the attorney pursued against my brother.

My mother keeps her home, keeps her pension, and keeps it now under the eye of someone who answers to a court instead of to himself. My brother is answering to that same court for what he did.

People ask me why I did not just handle it quietly, keep it in the family. The honest answer is that keeping it quiet is exactly what the person doing it was counting on. Silence is their best tool. The moment it goes on paper in front of the right people, the police, a regulator, a judge, the whole thing comes apart, because their scheme only ever worked in the dark. So I turned on the light. It is the one thing they never plan for.

He said he was protecting her from scammers. It turned out the scammer at the table was him. She is safe now, watched over by people whose job it is to watch, and she will not be quietly robbed by the one person she trusted most, not ever again. We saw to that, through the front door, the lawful way, and it held.
