A Letter From a Lawyer Id Never Hired Is What Tore the Lid Off

I walked straight up to the front of his fancy booth at the big lakeside home show, glossy photos of dream retreats, trusting couples browsing just like my wife and I once were, but I did not come to blow up. I came with a folder, and beside me stood a construction-fraud attorney and an investigator from the state contractor board.

The builder saw me and his salesman smile drained away.

He told me the LLC that built my cabin was dissolved, that I could not sue a company that does not exist, that he had done this a dozen times, but that phrase, I have done this a dozen times, turned out to be the very thing that undid him.

After he took our forty-year nest egg, poured a bad foundation, walked off, and got my dream cabin condemned, he thought dissolving his LLC put him beyond reach. But I did not accept that. I took everything to a construction-fraud attorney, who smiled when she read his letter.

Because dissolving the company does not erase the fraud, and it does not protect the man who committed it. When a builder takes money, does defective work he knows is defective, and folds the LLC to dodge responsibility, the law can pierce that shield and hold him personally liable. And doing it repeatedly, as he bragged, is a pattern that turns bad business into criminal fraud.

My attorney took his own words, I have done this a dozen times, and went looking for the other eleven. She found them. A dozen couples, most of them retirees who had saved their whole lives, each handed a condemned dream and a dissolved company and told there was nothing they could do.

Together, we were not a lone old man he could brush off. We were a dozen documented victims and a clear pattern of serial fraud, and the state contractor board and the district attorney were very interested.

So at the lakeside home show, as he sold dream retreats to the next trusting couple, the contractor board investigator arrived to pull his booth and his license, and my attorney served him, personally, with the consolidated lawsuit of a dozen cheated families.

The home show booth came down that afternoon.

The court pierced his dissolved LLCs, found him personally liable, and the fraud charges stuck. The dozen families, my wife and me among them, recovered our savings from his personal assets, garnished over the years to come. He was barred from ever building in the state again.

My wife and I got our forty years back, most of it. And with it, we finally built our little cabin on the lake, by an honest, bonded builder, and we spent our first night there watching the sun go down over the water we had dreamed about for four decades.

I never blew up. I just took his own bragging words and handed them to someone who could use them.

He said he had done this a dozen times, done his homework, and that I should have done mine. I did my homework, a little late. I found his other dozen victims, and together we did what he swore was impossible. Our dream cabin stands on the lake now, on a good foundation. And that man pours no more bad ones, for anybody.
