My Daughter Took My Car to Run My Errands and It Never Came Back

I walked around back to where they were all standing at her house for Easter dinner on the deck, but I did not come to make a scene. I came in my Sunday best, with a folder from my attorney, and the calm of a woman who had taken back her own independence.

My daughter saw me and went cold, sure the car was hers now and I was too old to argue.

She told me it was registered to her now, that I should not be driving, that if I pushed she would have a doctor say I could not live alone either, but she forgot that a car titled in my name is not hers to take just because she put it in her own name without my true consent.

After my daughter took my car to run my errands after my hip started acting up, then put it in her own name, said I was too old to drive safely, and left me stranded waiting on rides to my own doctor, threatening to have a doctor declare I could not live alone if I complained, I did not argue. I said you may be right, and I closed my door soft. And then I called a lawyer.

Because here is what my daughter never understood. That car was mine, titled in my name. Transferring it to herself without my genuine, informed consent, by taking advantage of my hip trouble and my trust, is not handling my errands. It is theft of my property and elder financial exploitation. And threatening to have me declared unable to live alone, to silence me, is coercion, which made it worse for her, not for me.

First, my competence and my independence. I got an independent evaluation, both of my mind, which was clearly sound, and of my ability to live on my own, which I plainly could. Her threat to have a doctor say otherwise died right there. And a driving assessment, which I passed, showed I was perfectly capable behind the wheel.

Then my attorney addressed the car. The improper transfer of my titled vehicle, taken without my true consent, was voidable, and the law does not look kindly on a daughter stealing her mothers car and her independence at once.

So at Easter dinner, on the deck, I did not stay silent. When my daughter looked at me coldly, I said, in front of the whole family: Happy Easter. I have news. My car, which was titled in my name, was put in my daughters name without my real consent, and my lawyer is reversing that. I also have a clean bill of health, of mind and of independence, and I passed my driving assessment. So I will be getting my car, and my freedom, back.

The deck went silent. The family turned to stare at her. And she had to explain, in front of everyone, how she had taken her mothers car and threatened her independence.

The transfer was reversed. My car came back to me, in my name. I drive myself to my own doctor now, on my own schedule.

She said I should not be behind the wheel. I passed every assessment, and I drive just fine, thank you. My car is mine again, and so is my freedom. I did not argue once. I just proved my independence and reclaimed my property, with help. My car is in my driveway, my keys in my purse. And my daughter learned that a mothers freedom is not hers to handle.
