I walked around back to where they were all standing at his boys graduation party, held at my own cottage, but I did not come to make a scene. I came in my Sunday best, with a folder from my attorney, and the calm of a woman who had spent the week reclaiming what was hers.
My nephew saw me and gave an easy grin, sure the too-old landlord had come to accept it quietly.
He told me I signed the cottage over free and clear, that it was a deed against my word, that I was too old to be a landlord, but he forgot that a deed obtained by a broken promise is not as free and clear as he believed.
After my nephew talked me into signing my little rental cottage over for tax reasons, swearing nothing would change and I would keep the income, then took the rent checks for himself and told me the repairs were not my problem or mine anymore, I did not come apart. I said maybe you are right, and I folded my hands. And then I called a lawyer.
Because here is what my nephew never understood. I signed that cottage over on his sworn promise that nothing would change, that I would keep the income, that it was purely for tax reasons. Getting an elderly aunt to sign away property by making promises you never intend to keep is not a legitimate deed. It is fraud in the inducement, and financial exploitation of an elder, and it can be undone.
My attorney reviewed everything. She found that the transfer had been obtained by deception, that his promise of continued income was part of the agreement and he had broken it, and that the whole arrangement was voidable as fraud.
The attorney moved to void the transfer and restore the cottage, and its income, to me.
So at the graduation party, on my own cottages lawn, I did not stay silent. When my nephew grinned at me, I said, in front of the whole family: What a lovely party, at my cottage. I should mention that my lawyer has shown my nephew got this cottage from me by promising I would keep the income, then broke that promise. The transfer is being reversed. The cottage is mine again, as it always should have been.
The lawn went quiet. The family turned to stare at him. And he had to explain, in front of everyone, how he had tricked his old aunt out of her late husbands cottage.
The court voided the transfer. My cottage came back to me, free and clear, along with the rent he had wrongly collected. My late husbands cottage was mine again.
He said I was too old to be a landlord. I was not too old to call a lawyer, and I have managed that cottage just fine for years. It is mine again, income and all. I did not lose my temper once. I just remembered that a promise is part of a bargain, and a bargain broken can be unmade. My husbands cottage is home again, in my hands, where he left it.
